I. DISPOSIZIONI GENERALI

1. In the context of these General Terms and Conditions of Service, the term "User(s)" shall be understood to mean both browser users and advertiser users.
2. The online advertisement dissemination service through the portal www.brokermania.it (the "Portal") is governed by these General Terms and Conditions of Service (the "General Terms and Conditions"), which are accepted by the User with the use of the Service.
3. Mind Design Group S.r.l., with registered office in Piombino (LI), Via Francesco Ferrer, 52 ("MIND DESIGN"), is the sole and lawful owner of the Portal, the associated software and all inherent exploitation rights.
4. MIND DESIGN may unilaterally make changes to these General Conditions at any time through notices published on the Network. In this case, MIND DESIGN will provide for highlighting to the User any modification with messages on the Portal's home page, in such a way that they are perceptible to the User before accessing the Portal. The subsequent use of the services displayed on the Portal by the User will constitute acceptance by the same of the General Conditions including the modifications or updates in question.
5. The use of the services displayed on the Portal is assumed by the User under her/his complete responsibility. MIND DESIGN does not offer any guarantee regarding the accuracy and reliability of the information contained in the Portal, nor does it offer any guarantee regarding the results obtained through the Portal and the successful outcome of the negotiations deriving from it.
6. The User may, by using the Portal, correspond with advertisers and other advertising promoters; in dependence of this, and in dependence of the information that the User makes public with their advertisement, the User may receive from third parties advertising material to the provenance and content of which MIND DESIGN is totally unrelated and for which it assumes no responsibility. MIND DESIGN declines all responsibility for the negotiations and subsequent commercial transactions deriving from such advertising promotions.
7. MIND DESIGN reserves the right to modify, suspend or discontinue, in whole or in part, the services displayed on the Portal, even without prior notice.
8. MIND DESIGN does not guarantee anything about: i) the identity, legal capacity, seriousness of intent or other characteristics of the advertisers, ii) the quality, lawfulness and safety of the goods that are the subject of the advertisements, iii) the truthfulness and accuracy of the descriptions provided. MIND DESIGN invites Users to pay due attention when replying to the advertisements.
9. These General Terms and Conditions of Service shall also apply to paid services, unless they conflict with any specific and separate agreements relating to such services.

II. REGOLE PER LA CONSULTAZIONE DEGLI ANNUNCI

1. MIND DESIGN offers a service of publication and consultation of advertisements on the Internet. MIND DESIGN is not responsible for the origin and truthfulness of the advertisements as well as their content and the actual existence of what is advertised in the advertisements, such responsibilities remaining exclusively with the user who has placed the advertisement. The search for information in the service and the display of the advertisements is carried out by means of automatic procedures, and therefore MIND DESIGN declines all responsibility regarding the content, accuracy, truthfulness and compliance with the rules contained in the General Conditions. The automatic search procedure could, furthermore, despite the express prohibitions provided for advertisers by the present General Conditions, lead to the consultation of information with content that is unpleasant or suitable for an adult audience, in relation to which MIND DESIGN declines all responsibility.
2. The User may nevertheless report any advertisements that do not comply with the rules set out in these General Conditions by sending a report to MIND DESIGN via the service Report an abuse
3. The use of the Portal is strictly personal and must be exercised under the terms set out in these General Terms and Conditions. The User acknowledges that the entire content of the Portal - including but not limited to text, software, music, sound, photographs, video, graphics or other - is protected by copyright, trademarks, service marks, patents or other proprietary rights and by specific provisions of law. The User has only the right to use the content of the Portal as expressly authorised by the Portal. The User may not in any way disseminate or reproduce what is contained in the Portal or make any use of it other than that authorised by the Portal, except as expressly authorised by the Portal itself or by MIND DESIGN. The User agrees not to perform any study of the Portal software for any reason, or allow any third party to do so.

III. REGOLE PER GLI INSERZIONISTI

1. The use of automatic ad loading systems is prohibited, unless explicitly authorised by MIND DESIGN.
2. The use of procedures, whether automatic or manual, with the aim of altering the normal sorting criteria adopted by the Portal in the listing and search of advertisements is expressly prohibited. This includes, but is not limited to, the deletion and reinsertion of the same advertisement in order to alter the date of insertion and/or the multiple insertion of the same advertisement.
3. Access to the service of publication and management of advertisements is allowed only through the exact completion of the online registration procedure. Upon completion of this procedure, the User will receive a confirmation email to the specified mailbox by which he/she will necessarily have to confirm his/her registration to the Portal.
4. The Advertiser acknowledges that the conclusion of the procedure of registration to the Portal guarantees him/her exclusively access to the reserved area specifically set up on the Portal itself, by means of which he/she will be able to begin immediately the management of his/her advertisements. However, any advertisements defined by the Advertiser and published by Himself, will be placed in the public domain only after the staff of the Portal has concluded the appropriate checks to verify that the General Conditions of the Portal have been complied with.
5. The Advertiser shall provide MIND DESIGN with the personal information requested by the Portal, also undertaking to keep it up-to-date and guaranteeing its truthfulness, completeness and accuracy. All information provided at the time of the original registration request will be included in the registration data (“Registration Data”). All Registration Data of the Advertiser will be processed and used by MIND DESIGN in compliance with the rules of confidentiality and security provided by law, as stated in the Privacy Policy
6. The Advertiser undertakes not to disrupt, directly or through third parties, the Portal in any way. MIND DESIGN shall not in any way be held responsible for the illicit, illegitimate, mendacious, inaccurate content of the advertisements, committing the Advertiser to indemnify and hold harmless MIND DESIGN from any claim in this regard.
7. MIND DESIGN shall not be liable for damages resulting from the failure to provide the Service under this Agreement if such damages are caused by problems in the operation of electronic means of communication beyond its reasonably foreseeable control. This includes, but is not limited to, the malfunctioning of servers and other electronic devices, even if not part of the Internet network, malfunctions of installed software, computer viruses, as well as actions of hackers or other users with access to the network.
8. The Advertiser also undertakes not to use the Portal for the publication, transmission, exchange of illicit, vulgar, obscene, slanderous, libelous, defamatory material, offensive to current morals, or, in any case, harmful to the rights of others or messages inciting racial or religious hatred and discrimination. In addition, the Advertiser agrees not to use the Portal in a manner that violates intellectual or industrial property rights of MIND DESIGN or third parties.
9. The Advertiser agrees and undertakes to abide by all network regulations, directives and procedures related to the Portal as well as the regulations, directives and procedures inherent in the Internet.
10. The Advertiser undertakes with respect to the content of the advertisements and the goods/services offered in the advertisements to comply with all provisions of applicable laws.
11. The Advertiser acknowledges and accepts that the use of the services displayed by the Portal is reserved exclusively for individuals in possession of regular VAT number operating in the sector of sale or rental of boats.
12. The Advertiser acknowledges and accepts that MIND DESIGN, while having the power to do so, is not required to exercise any editorial control over the messages sent through the Portal, without this determining any responsibility of MIND DESIGN. In any case, the Advertiser acknowledges to MIND DESIGN the widest faculty of technical processing of electronic communications, for the widest technical needs, and at the sole discretion of MIND DESIGN.
13. The Advertiser acknowledges and accepts the possibility offered by MIND DESIGN to have the advertisements also published on other websites or in the off-line magazines of MIND DESIGN, or belonging to the same corporate group of MIND DESIGN, or, in any case, belonging to third parties interested in promoting and/or publishing the Advertiser's advertisements. The Advertiser also consents to the use of the content of the advertisement (photos, text, etc, ...) by MIND DESIGN for the purpose of the publication of the same in the printed magazines, also agreeing to indemnify and hold harmless MIND DESIGN from any liability and/or claim in this regard.
14. The Advertiser agrees to indemnify and hold harmless MIND DESIGN, its affiliates, subsidiaries and investees, affiliates, employees and collaborators, from any claim or dispute, including any expense or charge, including any attorneys' fees, brought by any third party relating to the Advertiser's use of the services displayed by the Portal, the Advertiser's violation of these Terms and Conditions, the Advertiser's infringement of any intellectual property or other right of any person or entity.
15. The Advertiser expressly consents to the use of electronic mail as a means of distance communication.
16. Relations between MIND DESIGN and Users are governed by Italian law, under which these General Conditions shall also be interpreted. Except as provided by non-derogable provisions of law, the Court of Livorno shall have exclusive jurisdiction to settle any dispute concerning these General Conditions and the relationships governed by them.

IV. VIOLAZIONI, SOSPENSIONE ACCOUNT

1. MIND DESIGN will periodically monitor compliance with the requirements of these Terms. If it identifies a violation, it will promptly notify the advertiser to that effect and allow the advertiser a reasonable period of time to eliminate the violation. If the advertiser fails to comply with this request or does not do so within the specified time limit, MIND DESIGN reserves the right to block or delete content that violates the provisions of the Agreement and/or temporarily exclude the advertiser from the advertising platform. Blocking shall take place after adequate consideration of the interests of the advertiser and other interested parties in order to counteract potential negative effects and/or damages.
2. The right to extraordinary termination for cause and the assertion of further claims remain unaffected.

V. TARIFFE E SERVIZI

1. Use of the Portal is free of charge for navigator users. Certain services, however, may be chargeable. If certain services that are used are subject to payment of certain fees, the user may view and accept such fees according to the conditions that will be communicated before accessing said services. Fees are expressed in Euros and may be subject to change from time to time. Any changes in the rules regarding our rates will be posted on the site. In the event of promotions or new services, we may temporarily change our rates; these changes will take effect when the promotion or new service is announced.
2. Prices are in Euros (€) and do not include the current Value Added Tax (V.A.T.) for the relevant product category. The payment of the price shall be paid in advance, at the time of the conclusion of the contract, through the use of credit card, bank transfer or PayPal. MIND DESIGN, at the time of the conclusion of the contract having as its object the provision of paid services, has the right to inform the User that the management of the process of payment of the fee for the services, as well as the subsequent issuance and delivery of the resulting tax document, will be carried out by its own commission agent and / or, however, by a third party to whom it has been entrusted with specific assignment. It is understood that the processing of the User's personal data will, in any case, be carried out in full compliance with the purposes expressed in the privacy policy of MIND DESIGN, and, in any case, in accordance with the rules of confidentiality and security provided by law
